1. Agreement to Terms

By accessing or using Monary ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

2. Description of Service

Monary is a cryptocurrency copy trading platform that allows users to:

  • Track and monitor professional cryptocurrency traders ("Whales")
  • Automatically or manually copy trading positions
  • Manage trading parameters including position sizes, leverage, and risk limits
  • Access trading signals and market data from Hyperliquid exchange

3. Risk Disclosure

IMPORTANT RISK WARNING

Trading cryptocurrencies involves substantial risk of loss and is not suitable for all investors. The high degree of leverage can work against you as well as for you. Past performance is not indicative of future results.

You acknowledge and agree that:

  • You may lose some or all of your invested capital
  • Copy trading does not guarantee profits
  • Traders you copy may have different risk tolerances than you
  • Market conditions can change rapidly and unpredictably
  • Technical issues may affect trade execution
  • You are solely responsible for your trading decisions

4. Eligibility

To use Monary, you must:

  • Be at least 18 years old (or the age of majority in your jurisdiction)
  • Have the legal capacity to enter into binding contracts
  • Not be a resident of a jurisdiction where cryptocurrency trading is prohibited
  • Not be on any sanctions list or restricted from accessing financial services
  • Have your own cryptocurrency wallet and trading accounts

5. User Accounts

You are responsible for:

  • Maintaining the security of your wallet and private keys
  • All activities that occur under your account
  • Keeping your authentication credentials confidential
  • Notifying us immediately of any unauthorized access

6. Fees and Payments

Monary charges the following fees:

  • Platform Fee: 0.5% on profitable trades only
  • Subscription Fee: Monthly subscription for premium features
  • Performance Fee: 15% of profits shared with copied traders

All fees are subject to change with 30 days notice. Exchange fees from Hyperliquid are separate and charged by the exchange directly.

7. Prohibited Activities

You agree not to:

  • Use the Service for any illegal purpose
  • Manipulate markets or engage in wash trading
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Use automated systems to scrape or collect data without permission
  • Impersonate another person or entity
  • Share your account credentials with others

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Monary and are protected by international copyright, trademark, and other intellectual property laws.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of Liability

IN NO EVENT SHALL WHALESWAP, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold harmless Monary and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Monary operates, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. Material changes will be notified via email or prominent notice on the Service. Continued use after changes constitutes acceptance of the new Terms.
